Definition of Terms Used and Governing Law

"We", "us", “Dales” and "Dales Cycles" means Dales Cycles Limited. "You" and "the customer" means any private individual, using this website or purchasing goods or services from it.

"Goods and services" means any item or service offered for sale by Dales Cycles Limited on this website. A "confirmed order" and "the contract is agreed" means an order placed by a customer and accepted by Dales Cycles Limited.

"Working Days" means all days other than Saturdays, Sundays and Scottish statutory and public holidays. These Terms and Conditions and your use of this website shall be governed by and construed to be in accordance with the law of Scotland and you agree to submit to the non-exclusive jurisdiction of the Scottish court.

Using this Website and its Contents

We can only offer goods and services for sale to UK residents over 18 years of age.

To be eligible to purchase products on this Website and lawfully enter into and form contracts on this Website under Scottish law you must:

  • Register by providing your real name, phone number, e-mail address, payment details and other requested information
  • Be over 18 years of age
  • Possess a valid credit or debit card issued by a bank acceptable to us
  • Stipulate a delivery address in the United Kingdom. Please note that PO Box numbers, hotels and accommodation addresses are not acceptable.
  • Although we do our utmost to ensure all information on this website is correct and is as up-to-date as possible when you place an order, we cannot accept responsibility for any inaccuracies or errors beyond our reasonable control. Product dimensions given are intended to give an approximate indication of the size of individual products and product images are not to scale. We cannot guarantee that the images and colours of our products will be represented correctly on different computer monitors or other devices through which this website may be accessed. We reserve the right to refuse orders if items have been mispriced or if the item is no longer available.

Buying from this Website

By purchasing from this website you confirm that you are at least 18 years of age.

By filling in an electronic order form and submitting it to us you are making an offer to purchase from us. In doing so you confirm that the credit or debit card that is being used is your own.

We will send an email confirming your order details.

Our acceptance of your offer to purchase will result in a binding agreement between us under these Terms and Conditions.

Please note that we are under no obligation to accept your order but we would normally only refuse orders under exceptional circumstances.

These circumstances include (but are not limited to):

  • non-approval of payment by your credit card/debit card company
  • the item no longer being in stock
  • the item having being misrepresented or mispriced on our website
  • any unforeseen issues beyond our control such as courier disruption or changes to service

Pricing and Payment for Purchases

All prices quoted on this website are in Pounds Sterling and we can only accept payment in Pounds Sterling.

Prices are subject to increase without notice but we will never charge you more than the price stated in your order confirmation.

We accept the following major Debit and Credit Cards; VISA, VISA DEBIT, VISA ELECTRON, MASTERCARD, MASTERCARD DEBIT and MAESTRO. We also welcome payments from PAYPAL and offer V12 Finance if required.

Under normal circumstances payment will be taken immediately once you place your order.

All prices are inclusive of VAT (where applicable) at the current rates and are correct at the time of publishing the information to this site.

All credit/debit cardholders are subject to validation checks and authorisation by the card issuer. If the issuer of your payment card refuses to or does not, for any reason, authorise payment to us, we will not be liable for any delay or non-delivery.

Dales Cycles Competition and Prize Draw Terms & Conditions

The following are the terms and conditions for Dales Cycles competitions/prize draws ("Competition Terms and Conditions").

Please read these terms and conditions carefully. If you enter one of our competitions or prize draws, we will assume that you have read these Competition Terms and Conditions and that you agree to them.

  • To enter a competition you must be: (a) UK resident; and (b) 18 years old or over at the time of entry.
  • No purchase is necessary.
  • Only one entry is allowed per person.
  • You can enter Dales Cycles Limited competitions via the Dales Cycles website on the applicable competition page, or you can send your entry detailing which competition you wish to enter, together with your name, address and e-mail address by e-mail to: competitions@dalescycles.com. We may provide an alternative means of entry to specific competitions and details of how to enter these competitions shall be stated on the relevant competition advertisement.
  • Sending an e-mail is not proof that we have received your entry. No responsibility can be accepted for entries that are lost or delayed, or which are not received for any reason.
  • The start and closing dates are as specified in each competition advertisement.
  • If you win a competition, we will notify you by phone and/or e-mail. Dales Cycles decision will be final, and no correspondence will be entered into.
  • You can find out who has won a particular competition by sending a stamped addressed envelope, marked with the name of the competition to Dales Cycles Limited, Marketing Department, 40 Couper Street, Glasgow, G4 0DL after the closing date.
  • The winner will be selected at random by Dales Cycles Limited.
  • The prize will not be transferable to another person.
  • No part of a prize is exchangeable for cash or any other prize.
  • The prize is as set out in the competition advertisement. If an advertised prize is not available, we reserve the right to offer an alternative prize of equal or greater value.
  • Incorrectly completed entries will be disqualified.
  • Competitions and prize draws are promoted by Dales Cycles Limited, company number SC37712, having its registered office at Dales Cycles Limited, 150 Dobbies Loan, Glasgow, G4 0JE.
  • By submitting an entry to a Dales Cycles competition or prize draw the entrant hereby consents to Dales Cycles Limited using their personal information in accordance and compliance with these Competition Terms and Conditions and the Data Protection Act 1998. The information will be used for processing your entry, fulfilling Dales Cycles obligations under these Competition Terms and Conditions, and providing you with information about similar products and services offered by Dales Cycles Limited (unless you opt out of such communications). You may ask Dales Cycles to cease sending such information to you at any time by emailing or writing to us as the address provided above. Dales Cycles Limited will not give your details out to any third parties without your prior consent.
  • By entering the competition or prize draw the winner consents to use of their name and likeness (but not email or postal address) in such promotional activity and material as Dales Cycles may reasonably require, without additional compensation due to the winner. For example, the winner's name may be publicised as the winner of the competition on platforms such as Dales Cycles customer magazine, social media sites, postal or email marketing.
  • Dales Cycles reserves the right to amend these Competition Terms and Conditions at any time in circumstances out with our control. Dales Cycles may also create rules which will apply to a specific competition only. If we do this, we will publish the amended competition terms and conditions and/or specific competition rules on the relevant Dales Cycles competition webpage.
  • Any additional information relating to the specific competition or prize draw shall be included on the competition advertisement.
  • Dales Cycles will send prizes to the competition winner within 30 days of the competition end date, or as specified in each competition advertisement at the time of entry.
  • In the event of any conflict between the competition advertisement and these Competition Terms and Conditions, the terms of the competition advertisement shall apply unless expressly stated otherwise.
  • These Competition Terms and Conditions shall be construed and governed in accordance with the laws of Scotland and any disputes will be subject to the non-exclusive jurisdiction of the Scottish courts.

Offers, Vouchers, Promotion Terms & Conditions

Offers, Vouchers and Promotions are valid on selected full-price items while supplies last. Without limitation, discounts will not apply to sale merchandise, special bespoke orders, gift cards or back ordered items.

Offers, Vouchers and Promotions cannot be combined with any other offer or discount code. Discount will appear at the time of check out AFTER the code has been entered. The offer terms and conditions are subject to change at any time without prior notice. Other restrictions may apply.

Dales Cycles reserve the right to remove any offer or promotion without prior notice.

Reductions cannot be used with Finance options or Cycle to Work Scheme vouchers.

Handling your complaints

Dales Cycles Ltd aim to:

  • Acknowledge receipt of all complaints within 24 hours (or 1 business day*) of receiving it, or as soon as practicable.

  • Resolve all complaints within 30 days after receiving the complaint. This may not be possible in all circumstances. Where we cannot resolve a complaint within 30 days, we will notify you of the reason for the delay as well as an indication of when we expect to resolve the complaint.

  • Business days are considered Monday - Friday, excluding Scottish and/or UK Public Holidays

 

Terms And Conditions of Bike & Equipment Hire

 

These Terms and Conditions are the standard terms for the hire of bicycles and related equipment by Dales Cycles LTD

  1. Definitions and Interpretation
    1. In these Terms and Conditions, unless the context otherwise requires, the following expressions have the following meanings:
      • “Bike” means a bicycle supplied by Us and hired by You subject to these Terms and Conditions;
      • “Business Day” means, any day other than a Saturday, Sunday or bank holiday;
      • “Calendar Day” means any day of the year;
      • “Contract” means the contract for the hire of the Bike(s) by You from Us, as explained in Clause 3;
      • “Hire Agreement Order” means the online rental agreement completed by You specifying the details of Your Bike hire;
      • “Hire Period” means the period for which You will hire the Bike(s);
      • “Month” means a calendar month;
      • “Price” means the total price payable for the hire of the Bike(s) and/or Equipment.
      • “We/Us/Our” means Dales Cycles LTD
      • “You/Your” means you, the hirer of the Bike(s) and/or Equipment.
    2. Each reference in these Terms and Conditions to “writing” and any similar expression includes electronic communications whether sent by e-mail, text message,fax or other means.
    3. Each reference the singular number shall include the plural and vice versa where appropriate.

  1. The Contract
    1. These Terms and Conditions govern the hire of Bikes from Us and will form the basis of the Contract between Us and You. Before completing the Hire Agreement Order, please ensure that You have read these Terms and Conditions carefully.  If You are unsure about any part of these Terms and Conditions, please ask Us for clarification.
    2. Nothing provided by Us including, but not limited to, sales and marketing literature, price lists and other documents constitutes a contractual offer capable of acceptance. Your completed Hire Agreement Order constitutes a contractual offer that We may, at our discretion, accept.
    3. A legally binding contract between Us and You will be created upon Our acceptance of Your Hire Agreement Order, indicated by Your Hire Agreement Invoice, and Your payment of the Price.
  1. Bikes
    1. We use all reasonable endeavours to ensure that all Bikes are regularly maintained, safety checked, and/or replaced as necessary.
    2. At the time of hire, We will advise You on the appropriate size and type of Bike. You are under no obligation to follow Our advice, but We will not bear any liability for any injury or damage that results from Our advice not being followed.
    3. Hire bikes are supplied with helmets. We recommend the use of helmets at all times. We will not bear any liability for any injury or damage that results from Your failure to wear a cycle helmet.
  1. Your Responsibilities
    1. You are responsible for ensuring that You (and anyone else in Your party) use the Bike(s) safely and correctly and that You will, in, follow the relevant provisions of the Spanish Law.
    2. You are responsible for ensuring that You (and anyone else in Your party) are suitably physically fit to cycle without risk of injury.
    3. When hiring the Bike(s) You are acknowledging that cycling carries with it inherent risks including, but not limited to, those posed by road traffic; other cyclists; loose, slippery or uneven terrain; pedestrians; and animals. By continuing with the hire You acknowledge to Us that You accept all risks associated with cycling and that Our liability will be limited according to Clause 12.
    4. We do not provide any form of personal insurance and it is therefore Your responsibility to ensure that You (and anyone else in Your party) are covered by suitable insurance for the duration of the Hire Period
  1. Hire Period
    1. The Hire Period should be specified in the Hire Agreement Order.
    2. Unless it is expressly stated otherwise, the Hire Period begins at 10.00 and ends at 17.00 on the final day of the Hire Period.
    3. You may extend the Hire Period by prior agreement only. Please see our FAQ’s for details. Extended Hire Periods shall be charged at Our normal daily rate.
  1. Fees and Payment
    1. The price for the Bike(s) will be that shown on Our web site and in store, current at the time of Your hire.
    2. Full payment will be taken upon collection, or at time of booking, at the discretion of Dales Cycles Ltd.
    3. Prices include taxes.
    4. Card details retained.
  1. Cancellation of Advance Bookings
    1. Our cancellation policy is as follows:
      1. Cancellation made within 14 days of placing your booking and more than 30 days prior to the 1st day of hire - 100% refund.
      2. Cancellation made before 60 days prior to the 1st day of hire – 90% refund.
      3. Cancellation made between 31 days and 60 days of the 1st day of hire – 75% refund.
      4. Cancellation made between 14 days and 30 days of the 1st day of hire – 50% refund.
      5. Cancellations within 14 days of the 1st day of hire will forfeit the fee, no refund will be due.
    2. We may, at Our sole discretion, reduce or waive any of the charges detailed above if Your cancellation is due to exceptional circumstances.
  1. Collection, Hire and Return
    1. The Hire Period begins at 10.00 on the date stated in the Hire Agreement Order.
    2. You should check the Bike(s) at the time of collection. If there are any parts missing or if there is any visible damage to the Bike(s), You should inform Us immediately, before leaving the store.  We will use all reasonable endeavours to replace missing parts or damaged Bikes.  If We are unable to replace missing parts or damaged Bikes and the Bike(s) are not fit for safe use, You will receive a full refund of any sums already paid to Us.
    3. We are required by law to provide consumers with goods that are of satisfactory quality, fit for purpose, and in accordance with descriptions, samples, models and other pre-contract information provided by Us. If You discover any damage (pre-existing) or fault with the Bike(s) during the Hire Period, please inform Us as soon as is reasonably possible.  We will use all reasonable endeavours to provide a suitable replacement or, if a repair is possible without causing you any inconvenience, We will repair the Bike(s).  If We are unable to replace or repair the Bike(s), or if You would prefer to reject the damaged or faulty Bike(s), whether before or after a repair or replacement (if the replaced or repaired Bike(s) is still damaged or faulty), We will offer you a refund equal to the remaining, unused part of the Hire Period.  Any refund due to You will be made as soon as is reasonably possible, and in any event within 14 calendar days of the date on which We agree that You are entitled to a refund.  Refunds will be made using the same payment method originally used by You unless you specifically request a different method.
    4. The Hire Period ends at 17.00 on the date stated in the Hire Agreement Order. Any Bike(s) returned late will incur an excess charge of double the daily rate for that bike if You fail to return the Bike(s) before Our store closes on the day the Bike(s) is/are due to be returned.  Bikes may be returned early; however, We are unable to issue any refunds of any kind for early returns.
    5. Whilst bikes may be returned early, we are unable to offer refunds or partial refunds regardless of bad weather, physical fitness or any other personal reasons.
  1. Loss and Damage
    1. You are responsible for, and will be required to indemnify Us for, any loss or damage which may occur to Bikes.
    2. Full details of all charges are available on request.
  1. Our Liability
    1. We will be responsible for any foreseeable loss or damage that You may suffer only as a result of Our breach of these Terms and Conditions or as a result of Our negligence. Loss or damage is foreseeable only if it is an obvious consequence of Our breach or negligence or if it is contemplated by You and Us when the Contract is formed.  We will not be responsible for any loss or damage that is not foreseeable.
    2. In any event, Our total liability under these Terms and Conditions shall be limited to the value of the Contract between Us and You, that is, the total Price payable by You.
    3. Nothing in these Terms and Conditions seeks to exclude or limit Our liability for death or personal injury caused by Our negligence (including that of Our employees, agents or sub-contractors); or for fraud or fraudulent misrepresentation.
    4. Nothing in these Terms and Conditions seeks to exclude or limit Our liability with respect to Your legal rights as a consumer.   1. Events Outside of Our Control (Force Majeure)
    1. We will not be liable for any failure or delay in performing Our obligations where that failure or delay results from any cause that is beyond Our reasonable control.  Such causes include, but are not limited to: power failure, internet service provider failure, strikes, lock-outs or other industrial action by third parties, riots and other civil unrest, fire, explosion, flood, storms, earthquakes, subsidence, acts of terrorism (threatened or actual), acts of war (declared, undeclared, threatened, actual or preparations for war), epidemic or other natural disaster, or any other event that is beyond Our reasonable control.

  1. Other Important Terms
    1. We may transfer (assign) Our obligations and rights under these Terms and Conditions (and under the Contract, as applicable) to a third party (this may happen, for example, if We sell Our business). If this occurs, You will be informed by Us in writing.  Your rights under these Terms and Conditions will not be affected and Our obligations under these Terms will be transferred to the third party who will remain bound by them.
    2. You may not transfer (assign) Your obligations and rights under these Terms and Conditions (and under the Contract, as applicable) without Our express written permission.
    3. The Contract is between You and Us. It is not intended to benefit any other person or third party in any way and no such person or party will be entitled to enforce any provision of these Terms and Conditions.
    4. If any of the provisions of these Terms and Conditions are found to be unlawful, invalid or otherwise unenforceable by any court or other authority, that / those provision(s) shall be deemed severed from the remainder of these Terms and Conditions. The remainder of these Terms and Conditions shall be valid and enforceable.
    5. No failure or delay by Us in exercising any of Our rights under these Terms and Conditions means that We have waived that right, and no waiver by Us of a breach of any provision of these Terms and Conditions means that We will waive any subsequent breach of the same or any other provision.
